(Hereinafter referred to as “Sark Labs”).
The following terms and conditions apply to the website, products and services offered by Sark Labs. This includes the mobile and tablet versions as well as any other version of Sark Labs accessible via desktop, mobile, tablet, social media or other devices.
By using the website and purchasing the products/services/trainings/courses, you agree to be bound by these terms and conditions and our privacy policy. In these terms and conditions, the words “website” refer to the website, “we”, “us”, “our” and “Sark Labs” refer to Sark Consultancy Services Pvt. Ltd and “you” and “user” refer to you, the user of Sark Labs.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING, USING OR OBTAINING ANY MATERIALS, INFORMATION OR PRODUCTS.
Eligibility
Use of the website and purchase of products may only be made in accordance with these terms and conditions and all applicable local, national and international laws, rules and regulations.
Access to the website and the products available on the website are available to all ages, although we do not collect personal information from persons under the age of 13 (see privacy policy). It is the responsibility of parents or legal guardians to determine whether any of the content, services and products are appropriate for their children or minors under their guardianship.
By using the website and purchasing the products, you represent and warrant that you have full right, power and authority to enter into these terms and conditions and to fully perform all of your obligations hereunder. You further represent and warrant that you have no legal incapacity or contractual restriction that would prevent you from agreeing to these terms and conditions.
You represent and warrant that your use of the website does not violate any applicable law or regulation. Sark Labs may, in its sole discretion, refuse to offer the website and products to any user and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the website is revoked in such jurisdictions.
Account
If you register on Sark Labs, you will be required to choose a password, and you may be asked for additional information regarding your account. You are responsible for maintaining the confidentiality of your password and account information, and are fully responsible for all activities that occur under your password or account. The password and access to the account and related products/services/trainings/courses is non-transferable. You may not share your password or user account with another user or student. Sharing the password and user account with another user or student may result in the termination of the user's or student's account without any refund.
You agree to immediately notify Sark Labs of any unauthorized use of your password or account or any other breach of security, and to ensure that you log out of your account at the end of each session. You may never use another user's account without Sark Labs' prior authorization. Sark Labs will not be liable for any loss or damage arising from your breach of this agreement.
By providing Sark Labs with your email address & phone number, you agree that we may use these contact details to send you notifications about the status of your order, important communications about our services or products, news and special content. We may also use your contact details to send you notifications, such as changes to service features and special offers on our products and services.
If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through our contact information or by using the “unsubscribe” option in the emails. Opting out may prevent you from receiving emails about updates to your order, news or special offers on our products and services.
Users may cancel their accounts at any time and for any reason by sending us their request through our contact information. Such cancellation will only result in the deletion of the account and the deletion of all personal data granted to Sark Labs.
Sark Labs reserves the right to terminate your account or your access immediately, with or without notice to you, and without liability to you, if Sark Labs believes that you have breached any of these terms, furnished Sark Labs with false or misleading information, or interfered with use of the website or the service by others.
Products – Service / Training / Course / Webinar / Etc.
By placing an order for a product – service/training/course/webinar/etc. through the website, you are offering to purchase it for the price advertised and indicated on the website at the time you purchase the product. Please check the description of the content and features before placing the order. Once the payment process is completed, Sark Labs will send the user the login information and all the necessary information to access the purchased item.
When a user purchases a product, Sark Labs will send an email to the user to confirm the purchase and payment of the course. This confirmation email will contain the access information for the corresponding product.
Access to the product will be available on 1 device per user. In the event that the user wishes to access the course through another device, the user must submit a specific request through our contact information.
Sark Labs may cancel any order and may change or discontinue the availability of the products at any time at its sole discretion. If an order is cancelled, any payment made will be refunded in full. This does not affect your statutory rights.
All new orders are considered separately and each is treated individually.
For coaching & mentoring programs (tenure > 5 days), there will be a pre-onboarding and onboarding process which will be explained separately. The tenure of the program is initiated when any one of these is initiated – Brain Test is taken, Onboarding call is done, 5D Brain matrix tracker is shared, Learning portal access is shared with the user.
Prices
Sark Labs reserves the right to determine product – service/training/course/webinar/etc. pricing. The prices may be subject to change at any time without notice.
Sark Labs will use reasonable efforts to keep pricing information posted on the website up to date. You are encouraged to periodically check the website for updated pricing information for products/services/trainings/courses.
Sark Labs will always attempt to keep the prices on the website accurate. However, from time to time pricing errors may occur, including but not limited to human, mechanical or similar errors. If a pricing error is discovered, the customer will be informed of the error. User will have the option to reconfirm the order at the correct price or cancel the order if not satisfied with the correct price.
Payments
Products – services/trainings/courses/webinars/etc. can be paid through PayPal, Stripe, Razorpay or other payment processors available on the website. They can also be paid through cryptocurrencies if the option is made available. Charges are made immediately after completing the payment process.
Once the transaction is processed, an electronic receipt of the transaction will be sent to the email address provided during the purchase or registration process.
If you find any inconsistency in your billing, you may contact Sark Labs through the contact information or make the claim through the customer service of the corresponding payment platform.
If your card is declined, you will receive an error message and no payment will be charged and no order will be processed. Your bank may show a pending transaction until your card issuing bank withdraws the authorization, usually within 2 to 5 business days.
If your payment is declined, you must provide an alternative payment method or another card where payment can be charged and processed.
Your payment information will be treated and safeguarded with total security and with the exclusive purpose of processing the purchase of the products. Sark Labs reserves the right to contract any payment platform available in the market for this purpose.
Disclaimer
By accessing the website and purchasing the products, the user accepts personal responsibility for the results of using the information available in the course content. The user agrees and represents that Sark Labs does not guarantee any benefit, nor any type of positive or negative result from the use of the information obtained through the courses or the website in general. Resources and content are provided for informational and educational purposes only and your success or failure depends on your own efforts and circumstances.
Guarantees mentioning 365 days support do not imply 24x7 support. In case of partial satisfaction guarantees, a 365 days coaching support will be offered to the student and cannot be exploited to repeatedly attend live calls after 365 days of service. The maximum service delivery will be 365 days for coaching & mentorship program (not shorter programs like 5-day webinars).
Liability Limitation
Sark Labs provides all products and services, including webinars, coaching programs, digital downloads, and consulting services, for educational and informational purposes only and cannot guarantee specific results or outcomes.
Sark Labs shall not be liable for any direct, indirect, incidental, special, or consequential damages that result from the use or inability to use products or services, even if advised of the possibility of such damages, whether arising from negligence, breach of contract, or other legal theories.
All content, advice, and materials provided by Sark Labs are intended for educational purposes only and should not be construed as professional, financial, or legal advice.
Copyright
The content and copyrights of the products are the exclusive property of Sark Labs. Sark Labs owns all text, images, music, videos, worksheets, blog posts, reports, trademarks and other materials contained in the courses and on the website.
No content available in trainings/courses or on the website may be duplicated, distributed or used for unauthorized purposes without the express written consent of Sark Labs. Any unauthorized use may result in claims and lawsuits for infringement.
All materials on Sark Labs are protected by copyrights, trademarks and/or other intellectual property rights and are made available for limited, non-commercial, personal use only. No material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed without prior express written permission.
Copyright Infringement
Sark Labs will respond to all inquiries, complaints and claims related to alleged infringement under applicable copyright and intellectual property laws. Sark Labs respects the intellectual property of others and expects users to do the same.
If you believe any material on the website infringes your rights, you must submit a request via the contact information with: a statement identifying the infringing material, your contact details, a good faith statement regarding unauthorized use, a statement under penalty of perjury regarding accuracy, and your electronic or physical signature or that of an authorized representative.
Intellectual Property Rights
All content provided by Sark Labs, including digital downloads, webinars, coaching materials, and consulting documents, is protected by copyright laws. By purchasing or accessing any Sark Labs content, you are granted a non-exclusive, non-transferable license to use the content for personal, non-commercial purposes.
Customers purchase a license to use content, not ownership. Reselling, sharing, or distributing Sark Labs content in any form is strictly prohibited and may result in immediate termination of the license and legal action.
Sark Labs retains full ownership of all intellectual property rights related to the content, including all copyrights, trademarks, and proprietary rights, including recordings of all live calls which may be used ethically for business purposes like marketing and testimonials.
Referral Program
Users may register in the referral program and earn commissions for sales made through affiliate links provided by Sark Labs. For each purchase of products – services/trainings/courses/webinars/etc. made through the affiliate link, the affiliate user will receive a percentage as commission.
Commissions will be credited to the user’s account and may be withdrawn through payment processors available on the website. Affiliate links are unique and non-transferable.
Advertising
Through the website, Sark Labs may make available commercial and advertising information of its own or third parties in accordance with good business practices. Sark Labs does not endorse, guarantee or assume responsibility for services or products marketed by third parties.
Users are fully responsible for accessing third-party sites and must verify and know the conditions of the services offered by such third parties.
Prohibited Activities
The content and information available on the website, as well as the infrastructure used to provide such content and information, are owned by or licensed to Sark Labs. For all content other than your own, you agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or resell any information or services obtained from or through the website.
Prohibited activities include: using robots or scrapers to access content; imposing unreasonable load on infrastructure; deep-linking without permission; framing or mirroring services; reverse engineering any software; and evading or interfering with security-related features.
Third Parties
Through use of the website and services you may encounter links to third party websites or interact with third party sites that may charge fees for certain content or services. You must investigate and determine whether charges will be incurred before proceeding with any transaction.
Any interactions with third party sites and apps are at your own risk and Sark Labs is not responsible or liable for any such third-party sites.
Indemnification
You agree to defend and indemnify Sark Labs and its directors, employees and agents from and against any claims, losses, damages, fines, penalties or other costs, including reasonable legal and accounting fees, brought by third parties as a result of your breach of this agreement, violation of any law or third party rights, or purchase of products – services/trainings/courses/webinars/etc.
Electronic Communications
Sark Labs is not responsible for failed, partial or garbled computer transmissions, any hardware or software malfunctions, failures, connections, availability, acts or omissions of any service provider, internet accessibility or traffic congestion, or unauthorized human acts, including errors or mistakes.
Changes and Termination
Sark Labs may change the website and these terms at any time, in its sole discretion and without notice. You are responsible for remaining knowledgeable about these terms, and continued use constitutes acceptance of changes.
Sark Labs may terminate this agreement at any time by notifying you in writing (including by email) or without warning.
Personal Data
Any personal information you provide or submit in connection with the purchase of products/services/trainings/courses will be used in accordance with the Privacy Policy available on the website.
Integration Clause
This agreement together with the privacy policy and any other legal notices published by Sark Labs constitute the entire agreement between you and Sark Labs and govern your use of the website.
Disputes
Any dispute, claim or controversy arising out of or relating to these terms and conditions or use of the services shall be resolved by binding arbitration between you and Sark Labs, subject to each party’s right to bring an individual action in a court of competent jurisdiction.
The courts of India, specifically the courts of Pune, shall have jurisdiction over any dispute, controversy or claim relating to Sark Labs and its business operations.
Termination / Suspension of Access
Sark Labs reserves the right to suspend or terminate a user’s access to any program, live calls, communities, tools, or services—without refund—if the user violates these Terms, the Refund Policy, or the Code of Conduct; engages in harassment or abusive behavior; misuses program materials or systems; or is involved in fraudulent, unlawful, or unethical acts connected to Sark Labs services.
Termination under this clause does not waive Sark Labs’ right to pursue legal remedies.
Refunds
Webinars: Refunds for webinars are not allowed. If you miss the webinar, you may attend a future webinar date if offered, but no refunds will be provided. If the webinar is cancelled by Sark Labs, you may receive a full refund or transfer to a rescheduled date.
Digital Downloads & Subscription Products: Due to the nature of digital products, all sales of digital downloads are final and non-refundable, except in case of technical issues reported within 7 days.
Coaching Program (tenure more than 1 day): For long duration coaching programs (typically 5 days or longer), refund requests must be submitted within 100 days from purchase. “Results refund” requests cannot be submitted before 70 days of enrollment.
Consulting Services: All sales of consulting services are final and non-refundable and are billed per agreed contract; cancellations or changes must be made at least 48 hours in advance.
Exceptions apply where the user has completed all required steps, demonstrated efforts via a “Proof of Completion” checklist and 1-1 call, and still not achieved results, in which case refunds may be considered with mutual discussion and agreement as per detailed conditions in the policy.
Refund requests that do not meet conditions, lack proof of completion, or are made after downloading content and immediately asking for refund will be denied; support may continue for denied refunds to help users complete action items.
PayPal refund requests will be denied if they do not comply with this policy; any rights and conditions remain as set out in the Refund Policy on the website.
Refund Processing
Once a refund request has been received and approved, please allow 3 to 7 business days for processing. Refunds will be issued via the original payment method.
If refund conditions mention more than 100% refund, Sark will hold the right to refund this in the form of cash or otherwise that holds similar value.
Payment Terms
Accepted Payment Methods: Sark Labs accepts various payment methods, including major credit cards, debit cards, and online gateways such as Razorpay, in the currency specified at purchase.
Recurring Payments: For subscription-based services, payments will be automatically charged at agreed intervals; you will be notified before renewal and may cancel by contacting support.
Failed Payments: In case of failed payments, Sark Labs may suspend access until payment is successfully processed.
Partial Payments: Refunds are not available where only partial payments have been made; Sark Labs may limit access and 1-1 calls in such cases, require completion of pending payments within defined timelines, and may pause or stop services without refund for continued default.
1-1 Calls: Where 1-1 calls are part of deliverables, the number of calls included will be specified; if not specified, only 1 call is included by default. Abuse of 1-1 calls is prohibited, though Sark may conduct extra calls case by case to support results.
Taxes and Additional Charges: Prices may be subject to applicable taxes and additional fees like currency conversion, which are the user’s responsibility.
Invoicing: Invoices will be issued per agreed terms, and payment is due upon receipt unless otherwise specified.
Service Specific Terms
Webinars: Sark Labs offers educational webinars designed to enhance cognitive skills, memory, reading speed, etc. Access to recorded sessions is not provided, but users may be offered to attend again on a future date at Sark Labs’ discretion.
Coaching Sessions: Coaching focuses on improving brain performance and cognitive abilities, with tailored sessions and agreed goals. No exam-specific guidance is provided, though support for professional exams is offered to the best of capabilities.
Pause Policy & Batch Movement: Students may pause their journey for genuine reasons; extensions of tenure are discretionary and pauses cannot be used to delay payments or game the system. Movement to different batches may be allowed to maintain momentum but repeated requests will not be entertained.
Consulting Services: Consulting includes professional advice and strategies related to cognitive enhancement, speed reading, and memory improvement, customized per client, often with an action plan after sessions.
Service Delivery
Sark Labs delivers services via online platforms (such as Zoom, Zoho, Microsoft Teams, or similar) and in-person sessions if agreed, depending on service nature and client preferences.
Clients are responsible for necessary technology and internet connectivity. In case of technical issues, Sark Labs will work with the client to reschedule at no additional cost, and in-person sessions will be at a mutually agreed location with any travel/accommodation expenses discussed in advance.
Coaching Reactivation & Discontinuation Policy
Enrollment is confirmed only after full or agreed installment payment, and access remains active only while payments are up to date. Default in payment may lead to suspension or permanent discontinuation, with partial payments treated as non-refundable.
Participants wishing to rejoin after default must enroll again as new participants under current fees and terms; Sark Labs does not guarantee reinstatement to the same batch, mentor, or structure.
Sark Labs ensures fair business practices and transparency and clarifies that suspension or denial of reactivation due to non-payment does not constitute deficiency of service under the Consumer Protection Act (2019). In exceptional cases, goodwill discounts may be offered at management discretion.
Code of Conduct
By enrolling, participants agree to maintain respectful, professional communication with Sark Labs staff, trainers, contractors, and other learners. Abusive, defamatory, harassing, hateful, or threatening behavior is prohibited.
Disruptions, unauthorized sharing, confidentiality breaches, unauthorized recording or copying, and sharing services with non-purchasers are strictly prohibited. Violations may result in warnings, restricted communication, suspension, or permanent termination without refund.
Communication Channels: Sark Labs may designate appropriate support channels and may restrict communication to email or disable communication in cases of misconduct. Cross-communication must remain professional and solicitation is not allowed.
Final Provisions
These terms and conditions are governed by the laws of India. Use of the website and purchase of products and services is not authorized in any jurisdiction that does not give effect to all provisions of these terms.
If any part of these terms is found invalid, illegal or unenforceable, the remaining provisions remain in full force. Failure or delay in enforcing any provision does not waive the right to enforce it later. Any rights not expressly granted herein are reserved.
## 26. ADDITIONAL COACHING, MENTORSHIP, REFUND, EVIDENCE, AND COMMUNICATION TERMS These additional terms apply to all Sark Labs coaching, mentorship, training, consulting, webinar, digital-learning, community, assessment, tracker, portal, app, and support-based programs. These terms are in addition to, and not in replacement of, the existing Terms & Conditions, Refund Policy, Privacy Policy, payment terms, and program-specific communications shared with the student/customer. Wherever a specific program email, invoice, checkout page, proposal, or written confirmation mentions specific deliverables, tenure, pricing, refund conditions, or access rules, those program-specific terms shall apply along with these Terms & Conditions. Nothing in these Terms is intended to limit any statutory right available to a consumer under applicable law. However, all refund, support, access, and dispute requests will be reviewed based on the actual program terms, delivery records, implementation records, communication history, and applicable law. ### 26.1 Program Nature and Student Responsibility Sark Labs programs are educational, coaching, mentoring, and implementation-support programs. Results depend on the student’s participation, consistency, implementation, practice, tracker usage, attendance, completion of tasks, communication with the support team, and personal circumstances. By enrolling, the student understands and agrees that: a) program outcomes cannot be guaranteed merely by payment or access; b) the student is required to sincerely participate, implement, practice, and follow the program process; c) learning results depend on repeated practice, application, feedback, and time; d) non-attendance, non-implementation, incomplete tracker usage, non-completion of onboarding, non-booking of required calls, or non-response to support follow-ups may affect outcomes; e) inability to participate due to personal schedule, work pressure, health, travel, exams, family events, or other personal reasons does not automatically create refund eligibility. ### 26.2 Program Activation and Commencement For coaching and mentorship programs, service delivery is considered to have started once any one or more of the following are initiated, shared, activated, accessed, or made available: a) learning portal access; b) app/practice access; c) live session access; d) webinar or coaching session access; e) pre-onboarding call, onboarding call, or onboarding recording; f) Brain Test, assessment, brain report, consultation, or analysis-related work; g) 5D Brain Matrix, Master Tracker, implementation tracker, worksheet, or task sheet; h) account manager or mentor allocation; i) WhatsApp/community/support group access; j) program deliverables email or access email; k) weekly plan, restart plan, or personalized implementation plan. Once the program is activated, internal costs, platform costs, mentor allocation, support infrastructure, administrative costs, assessment-related costs, and statutory/tax obligations may be incurred from Sark Labs’ side. ### 26.3 Onboarding, Pre-Onboarding, and Student Alignment Sark Labs may use a combination of live calls, recorded onboarding sessions, written instructions, trackers, portal walkthroughs, emails, forms, and account manager support to onboard students. A pre-onboarding recording, onboarding recording, portal access email, tracker access, or written instruction may be considered part of the onboarding process. A live 1:1 onboarding or alignment call may also be provided where included in the program structure. The student is responsible for: a) watching onboarding/pre-onboarding recordings shared; b) reading program emails and instructions; c) completing forms, trackers, assessments, and required preparation steps; d) booking required 1:1 calls where instructed; e) asking questions if any instruction is unclear; f) informing Sark Labs in writing if access is not received or if any onboarding instruction is not understood. Failure to complete onboarding steps, trackers, assessments, or required calls may result in incomplete program implementation and may affect refund eligibility. ### 26.4 Brain Test, Assessments, Reports, and Analysis Where a Brain Test, assessment, report, consultation, or analysis is included, Sark Labs may use internal tools, third-party tools, expert review, student inputs, forms, dashboards, tracker data, or other systems to generate or interpret insights. Assessment/report-related services may be considered activated or consumed once any of the following occurs: a) the assessment/test link is shared; b) the student starts or completes the assessment/test; c) student data is processed for report generation; d) Sark Labs reviews, studies, or prepares the report; e) expert analysis or consultation is initiated; f) the report is made available or scheduled for explanation. The detailed explanation of such report may happen during a 1:1 call or other review process. If the student does not book or attend the required explanation/alignment call, the explanation may remain pending, but the assessment/report-related service may still be treated as activated or consumed. ### 26.5 Trackers, Worksheets, Tasks, and Implementation Records Trackers, worksheets, task sheets, reflection sheets, daily sheets, weekly plans, and implementation records are part of the Sark Labs learning and accountability system. The student agrees that: a) tracker completion should reflect actual implementation; b) marking a tracker as complete without completing the corresponding learning portal task, assignment, worksheet, or practice may be treated as an implementation mismatch; c) Sark Labs may review portal analytics, tracker activity, form responses, attendance, call notes, and communication history to evaluate implementation; d) incomplete, inconsistent, or inaccurate tracker usage may affect refund eligibility; e) completion of work after submitting a refund request may not be considered for that refund evaluation unless Sark Labs agrees otherwise in writing. ### 26.6 Live Sessions, Recordings, Rescheduling, and Upload Timing Sark Labs may deliver programs through live sessions, recorded sessions, learning portal modules, practice tasks, community sessions, worksheets, trackers, or other learning methods. The student understands and agrees that: a) live sessions may be rescheduled, cancelled, clubbed, modified, or moved due to unavoidable personal, operational, technical, trainer, platform, or business reasons; b) if a live session is missed, cancelled, or rescheduled, Sark Labs may provide a future session, recording, alternative session, topic carry-forward, extension, or equivalent learning support, as appropriate; c) recording availability depends on third-party platform processing, internet, cloud conversion, upload time, and technical factors; d) any communicated recording upload time is an expected/indicative time and not an absolute guarantee unless specifically stated in writing; e) delay in recording upload due to cloud processing, platform dependency, or technical reasons will not by itself be treated as non-delivery of the program; f) the student should inform Sark Labs in writing if recording access is not received within a reasonable time. ### 26.7 Program Structure, Improvements, and Delivery Refinements Sark Labs may update, improve, refine, or modify the program structure, session format, worksheets, practice flow, tracker design, portal sequence, community format, or learning methodology to improve student outcomes, implementation, and operational quality. Such changes may include, without limitation: a) moving from daily tasks to alternate-day tasks; b) changing the sequence of modules; c) adding or removing worksheets; d) shifting some learning to recordings or portal modules; e) modifying live-session frequency; f) changing the role of account manager, mentor, or community support; g) adding additional support, pause, restart, or review options. Such refinements are part of the program improvement process and do not automatically create refund eligibility, provided the core program access, support, learning materials, or reasonable alternatives remain available. Where Sark Labs makes a substantial change that materially affects a paid deliverable, Sark Labs may communicate the change through live session, email, WhatsApp, portal notice, community update, or account manager communication. ### 26.8 Account Manager, Mentor, and Support Availability Where account manager or mentor support is provided, such support is meant for guidance, accountability, reminders, implementation support, and student assistance. The student understands and agrees that: a) account manager or mentor support does not mean 24x7 availability; b) exact-minute call availability is not guaranteed unless a call is scheduled through an official calendar slot or written confirmation; c) missed calls, delayed responses, or scheduling conflicts may occur due to operational reasons; d) support may be provided through WhatsApp, email, call, calendar booking, community, or portal, as decided by Sark Labs; e) repeated unscheduled calls, hostile communication, or unreasonable availability expectations may be redirected to scheduled support channels; f) Sark Labs may change the account manager, mentor, support channel, or support process where required. ### 26.9 1:1 Calls, Onboarding Calls, Alignment Calls, and Exit Calls Where 1:1 calls, onboarding calls, alignment calls, review calls, refund verification calls, or exit calls are part of the program or refund process, the student agrees to cooperate in scheduling and attending such calls. A required call may be used to: a) understand student goals; b) explain assessment/report insights; c) align the learning path; d) review tracker and implementation progress; e) address concerns; f) verify completion of refund conditions; g) understand the reason for discontinuation; h) provide a restart, pause, or support plan. If the student refuses to attend required calls, does not book the call, repeatedly reschedules, or does not respond, Sark Labs may proceed with review based on available records. Refusal or non-completion of required calls may affect refund eligibility where such calls are part of the program/refund process. ### 26.10 Pause, Validity Extension, Batch Movement, and Restart Support Pause, validity extension, batch movement, restart support, lighter learning plan, or reactivation support may be offered by Sark Labs as goodwill or student-support measures. These are not automatic rights unless specifically mentioned in the written program terms. A pause or extension: a) does not automatically extend payment deadlines; b) does not waive pending dues; c) does not create refund eligibility; d) may be subject to approval, availability, batch structure, trainer availability, and student conduct; e) may require written confirmation from the student; f) may not guarantee the same batch, mentor, account manager, structure, or schedule after resumption. ### 26.11 Partial Payment, Installments, Outstanding Dues, and Default Where a student enrolls through partial payment, EMI, installment, manual payment plan, deferred payment, or agreed payment schedule, the student remains responsible for clearing outstanding dues as per the agreed timeline. The student agrees that: a) pause, absence, non-attendance, dissatisfaction, or personal difficulty does not automatically extend payment deadlines; b) pending dues must be cleared as per commitment unless Sark Labs agrees otherwise in writing; c) failure to clear dues may result in suspension, limitation, or termination of access; d) partial payments are not eligible for refund unless Sark Labs expressly approves in writing; e) services already activated, consumed, or allocated cannot be treated as unused merely because full payment was not completed; f) Sark Labs may restrict access to learning materials, reports, calls, communities, or support until dues are cleared. ### 26.12 Voluntary Discontinuation or Withdrawal A student may personally choose to stop attending, stop participating, pause, or discontinue the program. Such voluntary discontinuation will be respected. However, voluntary discontinuation, non-attendance, non-response, non-implementation, inability to continue due to personal reasons, or withdrawal from the program does not automatically create eligibility for refund, partial refund, withdrawal payout, or fee reversal. If a student chooses not to continue, Sark Labs may keep program access available as per the applicable program terms, unless access is terminated for breach, expiry, payment default, or written closure. Any goodwill closure, partial credit, transfer, extension, or settlement offered by Sark Labs will be discretionary, case-specific, without admission of liability, and subject to written confirmation. ### 26.13 Refund Guarantee Clarification Any “Results Refund Guarantee,” “100-Day Results Refund Guarantee,” “Satisfaction Support,” or similar refund-related promise is subject to the specific refund conditions communicated for the program. Unless specifically stated otherwise in writing, a results-based refund is not: a) a no-questions-asked refund; b) an immediate cancellation refund; c) a walk-away refund; d) a refund due to personal schedule conflicts; e) a refund due to non-attendance; f) a refund due to change of mind; g) a refund due to refusal to implement the program process; h) a refund due to refusal to complete onboarding, trackers, assessments, calls, worksheets, or practice. For a results-based refund to be considered, the student must show sincere and timely implementation of the program process, including completion of required onboarding, tracker work, learning portal tasks, worksheets, practice assignments, calls, and other program steps applicable to the specific program. ### 26.14 Refund Request Window and Minimum Implementation Period For coaching and mentorship programs, refund requests must be submitted within the applicable refund deadline communicated for that program. Where the refund policy states that a results-based refund request cannot be submitted before a minimum implementation period, the student must complete that minimum period and required implementation steps before the refund request can be evaluated. Early dissatisfaction, incomplete participation, missed onboarding, non-attendance, or refusal to continue before the required implementation period may not qualify as a valid results-refund claim. ### 26.15 Proof of Completion and Refund Evaluation Records Sark Labs may require the student to submit proof of completion and implementation before evaluating any refund request. This may include, without limitation: a) tracker completion; b) learning portal progress; c) worksheets/tasks/assignments; d) practice logs; e) attendance records; f) call participation; g) form submissions; h) assessment completion; i) written reflections or progress reports; j) account manager review; k) mentor review; l) proof that the student followed the program process sincerely. Sark Labs may also rely on internal records such as portal analytics, call records, WhatsApp records, email records, support logs, dashboard data, attendance records, assessment records, and program delivery records to evaluate the request. ### 26.16 Evidence Sharing, Records, Call Recordings, and Confidentiality Sark Labs may record calls, live sessions, support calls, onboarding calls, mentoring calls, review calls, exit calls, and community sessions for training, quality, safety, evidence, compliance, dispute review, and service-improvement purposes. By participating in such calls or sessions, the student acknowledges that such records may be retained and used by Sark Labs for legitimate business, service, compliance, quality, support, legal, or dispute-resolution purposes, subject to applicable law and the Privacy Policy. If a student requests evidence relied upon in a refund or dispute review, Sark Labs may share relevant records concerning that student’s own enrollment and interactions in a controlled manner. Sark Labs may refuse to share, or may redact, restrict, watermark, or limit access to: a) other students’ personal data; b) employee private information; c) internal team notes; d) backend dashboards; e) proprietary operating systems; f) third-party confidential platform data; g) internal business processes; h) unrelated communications; i) records not relevant to the dispute. Full call recordings, transcripts, internal analytics, assessment dashboards, backend screenshots, or sensitive records may be shared only through a secure access-controlled link, supervised review, redacted PDF, transcript, or after execution of a Confidentiality and Responsible Use Undertaking, as decided by Sark Labs. Records shared for review must not be edited, clipped, circulated, uploaded, published, misrepresented, selectively quoted, or used outside the specific refund/dispute context, except where required for legal advice, lawful complaint, court, consumer forum, police, regulator, or other legally authorized process. ### 26.17 Communication Channels During Refunds or Disputes Sark Labs may designate the appropriate communication channel for refund requests, grievances, disputes, evidence sharing, or escalation. Sark Labs may require such matters to be handled only over email or a formal support ticket. Refund/dispute discussions should not be posted in student learning groups, WhatsApp communities, live classes, practice communities, or public learning forums, because such groups are meant for learning, practice, accountability, and student progress. Sark Labs may remove, restrict, or moderate messages that are unrelated to learning, disruptive, defamatory, threatening, repetitive, hostile, or likely to create confusion among other students. Such moderation does not mean that the concern is ignored. The concern may be moved to the appropriate formal channel. ### 26.18 Respectful Communication, Public Statements, and Misuse of Records Students are free to raise genuine concerns, complaints, and feedback through appropriate channels. Sark Labs respects the right of students to seek lawful remedies. However, the student agrees not to: a) make false, misleading, defamatory, abusive, threatening, or malicious statements about Sark Labs, its trainers, team members, students, partners, or programs; b) publish edited, clipped, incomplete, or misleading screenshots/recordings; c) publish private call recordings, employee voice data, internal dashboards, confidential records, or third-party platform information without authorization; d) harass, threaten, intimidate, or repeatedly target Sark Labs staff, trainers, contractors, students, or community members; e) disrupt learning communities or live sessions with refund/dispute-related allegations; f) misuse evidence shared for review by circulating it outside the purpose for which it was shared. Nothing in this clause prevents a student from seeking legal advice, approaching a court, consumer forum, regulator, police authority, payment provider, or any legally authorized forum in accordance with law. ### 26.19 Goodwill Support, Extensions, Credits, and Settlements Sark Labs may, at its discretion, offer goodwill support such as validity extension, batch change, lighter restart plan, additional call, account manager change, additional review, access extension, credit, partial closure, or settlement. Any such goodwill support: a) is discretionary; b) does not mean admission of service deficiency, liability, or refund entitlement; c) may be subject to written acceptance; d) may be withdrawn if misused; e) may be offered case-by-case and does not create precedent for other students. ### 26.20 Chargebacks, Payment Disputes, and Duplicate Refund Routes If a student raises a refund request with Sark Labs and also raises a chargeback/payment dispute with a bank, card issuer, payment gateway, EMI provider, or third-party platform, Sark Labs may respond to such dispute with its records, terms, invoices, delivery proof, access logs, call records, and communication history. A student should not pursue duplicate refund routes for the same transaction in a misleading manner. If any amount is refunded through a payment provider, bank, card issuer, or legal process, Sark Labs may adjust or recover the corresponding access, benefits, dues, invoices, taxes, or services in accordance with law. ### 26.21 Taxes, GST, Platform Costs, and Non-Reversible Costs Where fees include GST, taxes, platform charges, payment gateway charges, assessment charges, expert review costs, software costs, onboarding costs, mentor allocation, account manager allocation, administrative cost, or support infrastructure cost, such amounts may not be reversible once the service is activated, consumed, allocated, or legally reported. Any refund, if approved, may be subject to deduction of applicable non-reversible costs, taxes, gateway charges, consumed services, assessment costs, administrative costs, and statutory obligations, unless prohibited by applicable law or expressly agreed otherwise in writing. ### 26.22 Donation-Linked Discounts, Scholarships, and Special Pricing Sark Labs may offer scholarships, discounts, community-service discounts, donation-linked discounts, limited-period offers, or special pricing at its discretion. Unless specifically stated otherwise: a) donation-linked discounts are optional; b) the donation is not made to Sark Labs unless clearly specified; c) the student may choose whether or not to avail such discount; d) special pricing does not alter the refund policy unless expressly stated in writing; e) discounts, scholarships, or special pricing cannot be later converted into cash claims. ### 26.23 Email, WhatsApp, Portal, and System Records as Evidence The student agrees that Sark Labs may rely on emails, WhatsApp messages, call logs, call recordings, portal activity, tracker records, attendance records, dashboard records, payment records, access logs, form submissions, and support records to verify service delivery, student participation, refund eligibility, and dispute facts. Such records may be used for internal review, refund review, quality control, evidence preservation, legal response, payment dispute response, or regulatory/consumer forum response, subject to applicable law and privacy obligations. ### 26.24 Final Refund Decision and Continued Support Once Sark Labs reviews a refund request and communicates its decision, the refund request may be treated as closed from Sark Labs’ side unless the student provides new material evidence that was not previously available or considered. If a refund request is denied, Sark Labs may still continue to support the student in completing the program through available access, pause/resume support, restart plan, scheduled support, validity extension, account manager support, or other reasonable assistance, subject to program terms, student conduct, payment status, and access validity. Refund denial does not mean that Sark Labs is unwilling to support the student. It means that the request does not meet the applicable refund conditions based on the records reviewed. ### 26.25 Non-Retroactive Application and Acceptance of Updated Terms These additional terms apply from the date they are published or otherwise communicated. For existing students, these terms may apply to future use, future access, continued participation, future support, future renewals, future evidence-sharing, or future dispute handling to the extent permitted by law and communicated to the student. Sark Labs may require students to accept updated terms through checkbox confirmation, email confirmation, portal login confirmation, invoice terms, payment page, Zoho Sign, or any other written/electronic method. Continued access to Sark Labs programs, portals, communities, calls, or support after notice of updated terms may be treated as acceptance of the updated terms, to the extent permitted by law.Contact Information
